TERMS AND CONDITIONS
AGREEMENT OVERVIEW:
This Agreement expresses the full and complete agreement between the named parties and Megan Rae Photography regarding the subject matter hereof. It supersedes all prior agreements. The only way to add, or change, this agreement is to do so in writing, signed by all parties.
Upon signature, Megan Rae Photography shall reserve the time and date agreed upon. The parties agree that good faith, cooperation, and communication between them is important in obtaining good results. Megan Rae Photography recommends that client identify to the photographer important individuals during the event and during associated portraits, if they wish to have them photographed. Megan Rae Photography will not be held accountable for not photographing desired guests if there is no one to assist in identifying and gathering people for photographs. Megan Rae Photography is not responsible if key individuals fail to appear or cooperate during photography, or for missed images due to details not revealed to Megan Rae Photography or beyond the photographer’s control. No part of any order will be delivered until the balance is paid in full.
For all purposes of this document, Megan Rae Photography will be referred to as “Photographer”.
RETAINER:
An initial retainer of 25% of total Collection cost and a signed contract must be secured prior to any services being performed by Photographer.
CONTRACTED PACKAGE:
Includes all services described in selected package details reviewed and distributed to clients. Any additional services requested by the client incurred by Photographer will be billed directly to client at cost. All services contracted cannot be deducted, but additional services can be added.
For your convenience, payments to Photographer can be made through secured Square up.
OVERTIME:
Additional unplanned and/or un-contracted services (such as, but not limited to, full redo of design, day of wedding extension of time, services outside of scope of agreement, management of non wedding day activities, etc) are considered overtime and will be billed with prior notification and consent at the rate of $200 per hour.
CANCELLATION POLICY:
If event is canceled, no portion of the fees paid to Photographer will be returned. If event is canceled less than 6 months before date, 2nd payment will be required to compensate for hours of service already rendered and loss of event date. If the event is postponed, services contracted can be applied to a new date if available (refer to Postponement Policy).
COPYRIGHT and REPRODUCTIONS:
The Photographer shall own the copyright in ALL images created and shall have the exclusive right to make reproductions. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, or for display within or on the outside of the Photographer’s studio. If the Photographer desires to make other uses, the Photographer shall not do so without first obtaining the written permission of the Client.
POSTPONEMENT POLICY:
If the event is postponed, all services will cease at time of notification of postponement if no determined new date is provided. Payment schedule will be determined and readjusted post new event date notification. If client requires services to resume, post new event date being established, second payment will be required at time of service re-start.
CLIENT'S USAGE:
The Client is obtaining prints and/or digital files for personal use only, and shall not sell said prints and/or digital files or authorize any reproductions thereof by parties other than the Photographer. If Client is obtaining a print and/or digital file for reproduction, Photographer authorizes Client to reproduce the print only as set forth under the Portrait Release given with the finished order. In such event, Client shall request that a credit for the Photographer be placed adjacent to the photograph on publication, but shall have no liability if the publication refuses or omits to do so.
RESPONSIBILITY:
Photographer is not responsible for Acts Of God, Natural Disasters, an Act Of Government such as A Declaration of National or Local Emergency, or Other Incidents Not within the control of the consultant, i.e. accident, death in the family, illness, pregnancy, or sudden tragic circumstance. In such a situation, consultant will obtain, upon approval of the client, a qualified professional replacement to fulfill Tonya Bliss Photography obligations under the contract, at no additional charge to the client.
PERMITS:
The Client is responsible for acquiring all permits and necessary permission for all locations on which the Photographer will be performing services.
FINAL IMAGES:
Final images are individually edited at the full discretion of the Photographer. These images are used for high resolution files and albums. Client is PROHIBITED from altering ANY and ALL images in ANY way. Photographer will edit photos for color correction, exposure ,and basic retouches including blemishes, stray hairs, and minor wardrobe malfunctions if feasibly possible. Extensive editing at the request of the Client can be purchased at an additional fee of $150 per hour.
MODEL RELEASE:
The Client hereby assigns the Photographer the irrevocable and unrestricted right to use and publish photographs of the Client, Client’s family members, and/or Client’s property or photographs in which the Client may be included, for editorial, trade, advertising, educational and any other purpose and in any manner and medium; to alter the same without restriction; and to copyright the same without restriction. The Client releases all claim to profits that may arise from use of images.
CAPTURE AND DELIVERY:
The Photographer is not liable to deliver every image taken at the event. The determination of images delivered to the Client is left to the discretion of the Photographer.
EVENT AND FOOD SERVICE:
A meal must be provided by Client for Photographer for events FIVE (5) hours or longer. Photographer additionally requests to be seated in the same room as the guests, but at a table where frequent standing up, moving around, and sitting down in order to capture moments as they occur will not be a distraction.
PAYMENT SCHEDULE AND METHOD:
For your convenience, payments can be made online via Sessions Square Up using a valid credit card. Otherwise, payment is to be made by cash or check. 25% initial retainer due upon completion of the signed agreement for services. Remaining balance is due the week before event.
COMPLETION SCHEDULE:
Images are expected to be completed within 4-6 weeks of the event date. Flashdrive creation/online gallery is expected within 4-6 weeks of the event date and will be mailed out/hand delivered within 4-6 weeks of the event date. Printed items and albums require additional time.
ATTORNEY:
If legal action is necessary to enforce the terms of this contract the prevailing party shall be entitled to reasonable attorney fees in additional to any other remedies to which that party might be legally entitled.
LIABILITY:
It is understood that Photographer is only liable for services completed and provided by Photographer and cannot be held liable for the services of other contracted vendors. It is understood that in no event shall Photographer be liable for consequential damages of any kind.
DAMAGE OR LOSS OF ACCESSORIES:
Client agrees to exercise all due care in caring for, and preserving the property of Photographer. Clients shall remain responsible for all loss or damage to rentals, up to and including actual replacement value for each missing or damaged item per cost.
APPROPRIATE CONDUCT/SAFE WORKING ENVIRONMENT:
The Client(s) expressly agree(s) to take best efforts to provide Megan Rae Photography and staff with safe and appropriate working conditions. In the event of circumstances deemed by either Megan Rae Photography  or a bystander to present a threat or implied threat of injury or harm to Megan Rae Photography staff or equipment, we reserves the right to cancel all services remaining under this Agreement and leave the event. At Megan Rae Photography’s discretion, the Photographer may enact a three-strike policy. After the first offense, Megan Rae Photography will make reasonable efforts to notify the Client(s) or a responsible party. If the Client(s) is/are able to respond to the threatening situation in a reasonable amount of time (maximum of 15 minutes), Megan Rae Photography shall resume work in accordance with the original terms of this Agreement. If the threatening behavior occurs for a second time, the Client(s) will agree to remove the offending person for the remainder of the event. If the behavior occurs a third time, Megan Rae Photography will immediately leave the event. If Megan Rae Photography leaves the event early due to any offending behavior, the Client(s) expressly agree to relieve and hold Megan Rae Photography harmless as a result of incomplete event coverage, or for a lapse in the quality of Megan Rae Photography’s work, and the Client(s) shall be responsible for payment in full.
MISCELLANEOUS
This Agreement incorporates the entire understanding of the parties. Any modifications of this Agreement must be in writing and signed by both parties. Any waiver of a breach or default hereunder shall not be deemed a waiver of a subsequent breach or default of either the same provision or any other provision of this Agreement. This Agreement shall be governed by the laws of the State of Michigan.
For valuable consideration received, I grant to Megan Rae Photography ("Photographer") the absolute and irrevocable right and unrestricted permission concerning any photographs that she has taken or may take of me or in which I may be included with others, to use, reuse, publish, and republish the photographs in whole or in part, individually ornin connection with other material, in any and all media now or hereafter known, including the internet, and for any purpose whatsoever, specifically including illustration, promotion, art, editorial, advertising, and trade, without restriction as to alteration; and to use my name in connection with any use if she so chooses. I release and discharge Photographer from any and all claims and demands that may arise out of or in connection with the use of the photographs, including without limitation any and all claims for libel or violation of any right of publicity or privacy. This authorization and release shall also inure to the benefit of the heirs, legal representatives, licensees, and assigns of Photographer, as well as the person(s) for whom she took the photographs. I am a legally competent adult and have the right to contract in my own name. I have read this document and fully understand its contents. This release shall be binding upon me and my heirs, legal representatives, and assigns.
